FHFA Makes Criminal Referral Against NY Attorney General

The agency alleges she listed a home in Virginia as her primary residence, among other issues related to mortgage fraud.

The Federal Housing Finance Agency (FHFA) filed a criminal referral with the Justice Department (DOJ) against New York Attorney General Letitia James for falsified records in a case of mortgage fraud. The referral alleged that she attempted to secure more favorable loan terms by listing her home in Virginia as her primary residence rather than her home in New York.

“At the time of the 2023 Norfolk, VA property purchase and mortgage, Ms. James was the sitting Attorney General of New York and is required by law to have her primary residence in the state of New York—even though her mortgage applications list her intent to have the Norfolk, VA property as her primary home,” the FHFA wrote in its referral, recommending the criminal investigation.

The NY attorney general is also accused of listing a five-bedroom property in Brooklyn as having one less bedroom to obtain more favorable financing. FHFA Director William Pulte submitted documentation showing that James and her father were falsely listed as “husband and wife” on other property purchases.

AG James prosecuted a civil fraud case against President Donald Trump last year. Her office cited this circumstance in response to the FHFA’s accusations, claiming the FHFA was weaponizing its systems against her.
