District Judge Places Second Block on the President’s Funding Pause

He issued a preliminary injunction against the “freeze of appropriated and obligated funds.”

District Judge John McConnell prohibited President Donald Trump’s administration from pausing federal grants and loans, issuing an indefinite preliminary injunction on the pause this week. This is the second block of the president’s financial freeze by a federal judge.

A group of 23 state attorneys general filed a lawsuit against the grant and loan freeze issued by the Office of Management and Budget (OMB), alleging that overriding financial decisions formally approved by Congress is an overreach of executive power. Though the executive office rescinded the memo to conduct the freeze, a large number of grants and loans have continued to be withheld.

Judge McConnell decided that a preliminary injunction on that memo and any similar instance of overreach was necessary. He wrote, “The Executive’s categorical freeze of appropriated and obligated funds fundamentally undermines the distinct constitutional roles of each branch of our government.”
