Supreme Court Upholds District Judge’s Order to Release USAID Funds

Justice Alito is joined by three other justices in his dissent.

The Supreme Court majority rejected an appeal from President Donald Trump’s administration to halt the mandate of a federal judge requiring the Trump administration to release the nearly $2 billion in funding for the U.S. Agency for International Development (USAID). The majority sent the issue back to the district court and required the judge to set a new deadline and amounts of USAID payments for the completed work for the administration to be in compliance.

Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh dissented from the majority, with Justice Alito writing an 8-page dissent opposing the power over the executive branch the decision offers to a district judge.

“Does a single district-court judge who likely lacks jurisdiction have the unchecked power to compel the Government of the United States to pay out (and probably lose forever) 2 billion taxpayer dollars? The answer to that question should be an emphatic ‘No,’ but a majority of this Court apparently thinks otherwise. I am stunned,” Justice Alito wrote.
