The Department of Education announced it is reverting Title IX standards from the 2024 update by President Biden’s administration to the 2020 policy of President Trump’s first administration. The letter referenced the federal court ruling last month that vacated the 2024 Title IX rule nationwide.
The reverted rules define “’sex’ to mean the objective, immutable characteristic of being born male or female,” rather than the broadened inclusion of gender identity and sexual orientation. Acting Assistant Secretary for Civil Rights Craig Trainor said the change was necessary to protect women’s rights “to safe and separate facilities and activities in schools, colleges, and universities.”
The change will also offer greater protections for students involved in sexual assault allegations.
