In the News…
Judge Reed O’Connor of the Northern Texas U.S. District Court rejected a plea deal Boeing tried to make with the Department of Justice based on the DEI contingency of the agreement. The plea deal pertains to the fraud case involving the 737 MAX crashes that killed 346 people.
Judge O’Connor said the court’s hands would have been tied by requiring it to consider diversity in appointing an independent monitor to oversee Boeing’s legal compliance going forward.
The judge noted “shifting and contradictory explanations” from prosecutors on how race or diversity could impact the monitor’s selection. He wrote, “In a case of this magnitude, it is in the utmost interest of justice that the public is confident this monitor selection is done based solely on competency.”
Both sides were ordered to update the court within 30 days.
