The 11th Circuit granted the DOJ’s request to dismiss.
On Tuesday, the Eleventh Circuit U.S. Court of Appeals granted the request of the Justice Department’s special counsel to dismiss the case against now-President-elect Donald Trump. The suit had claimed that the then-former president had unlawfully held classified documents at his Mar-a-Lago residence.
The Justice Department had announced the intent to dismiss after President Trump won the election earlier this month.
The special counsel’s office stated, “After careful consideration, the Department has determined that [Office of Legal Counsel’s] prior opinions concerning the Constitution’s prohibition on federal indictment and prosecution of a sitting President apply to this situation and that as a result this prosecution must be dismissed before the defendant is inaugurated.“
