Edward Earl Carnes was born in June 1950 in Albertville, Alabama. He earned an undergraduate degree from the University of Alabama. He received his Juris Doctor from Harvard Law School.

Carnes became an assistant state attorney general and the Chief of the Capital Punishment and Post-Conviction Litigation Division of the Alabama State Attorney General’s Office.

President George H.W. Bush nominated Carnes for a seat on the United States Court of Appeals for the Eleventh Circuit in January 1992. His nomination was confirmed by the Senate, and he received his commission in September 1992. Carnes assumed senior status in June of 2020.

In the News…

Judge Ed Carnes of the Eleventh Circuit U.S. Court of Appeals concurred with the reinstatement of a defamation suit filed by Project Veritas against CNN. A lower court had granted the media outlet’s request for dismissal.

Project Veritas filed suit against CNN because its journalists had claimed that the conservative group was banned from then-Twitter social media for misinformation, when it was actually due to revealing private information.

Judge Carnes wrote, “I never thought I’d see a major news organization downplaying the importance of telling the truth in its broadcasts. But that is what CNN has done in this case. Through its lawyers CNN has urged this Court to adopt the position that under the law it is no worse for a news organization to spread or promote misinformation than it is to truthfully disclose a person’s address in a broadcast.
