The six transit workers lost their jobs at BART for refusing the Covid vaccine.
A federal jury in the Northern California U.S. District Court awarded $7 million to transit workers who were not given religious accommodations for their refusal to get the Covid vaccine. The plaintiffs, who lost their jobs, stated that Bay Area Rapid Transit (BART) was unable to provide evidence that there would be an “undue hardship in denying any accommodations to the employees.”
The company published a policy that made vaccination a condition of employment in October 2021. While BART allowed religious exemptions in certain cases, the employer denied accommodations in every instance. The employees who requested religious exemptions were eventually fired or forced to resign or retire. By contrast, BART often granted accommodations for medical exemptions. The lawsuit alleged that the company violated California’s Fair Employment and Housing Act.
