Supreme Court Declines to Hear Appeal on Texas Abortion Law

Fifth Circuit’s ruling in favor of Texas will stand.

The U.S. Supreme Court declined the take up the appeal from President Biden’s administration regarding a Texas law that bars hospitals from providing abortions in emergency situations if they would violate the state law. The law already has an exception for serious risks to the health of a pregnant woman.

The Justice Department, on behalf of the Department of Health and Human Services, tried to make a case that the state law violated the Emergency Medical Treatment and Labor Act. The Fifth Circuit U.S. Court of Appeals ruled, “EMTALA does not mandate medical treatments, let alone abortion care, nor does it preempt Texas law.“

Abortion rights and restrictions are an important issue in the upcoming presidential election.
