The Federal Trade Commission (FTC) has expressed support for a new rule proposed by the U.S. Department of Agriculture (USDA) intended to safeguard farmers, ranchers, and consumers from unfair practices by dominant meat processors. The proposed rule seeks to clarify what constitutes unfair practices under the Packers and Stockyards Act (PSA), which was established to ensure fair competition and trade practices.
The FTC highlighted the importance of the proposed rule in promoting a more equitable and resilient food system. The agency stressed that the PSA should not make it difficult for farmers to seek justice, particularly when lower food costs and supply chain stability are urgently needed. The FTC also noted that a documented competitive injury is not required for a PSA violation, aligning the rule with the PSA’s text and its connection to the FTC Act.
