The action stems from the settlement of an ACLU lawsuit over policies from the prior administration.
President Biden’s administration intends to offer temporary legal status to illegal immigrants who were separated at the border between 2017 and 2021. The action would include 3-year work permits as well as the ability to officially apply for asylum. Temporary housing and some healthcare would be included among the benefits.
The plan, part of a settlement in a case brought by the American Civil Liberties Union which must be approved by a U.S. district judge, would also prohibit the government from utilizing the policy of separating families for eight years, with certain exceptions including “reasons of national security, criminal warrants, medical emergencies or if a child’s safety is at risk.“
Under the deal, the Departments of Justice and Homeland Security have agreed to grant temporary legal status to the families of 3,900 children. DHS Secretary Alejandro Mayorkas said, “The Department of Homeland Security has taken steps to ensure that the prior practice of separating families does not happen again, and we are continuing the work of reuniting children with their parents.”
