NO FAKES Act intended to hold producers of unauthorized recreations accountable.
Four senators recently introduced legislation that would hold individuals and organizations liable for creating and releasing unauthorized replicas of performing artists.
Titled the Nurture Originals, Foster Art, and Keep Entertainment Safe (NO FAKES) Act, the bill is intended to hold those accountable who use artificial intelligence (AI) to produce unsanctioned reproductions of well-known singers and actors. The bill makes exceptions for situations covered by the First Amendment rights, such as instances of parody, satire, and historical works.
“Creators around the nation are calling on Congress to lay out clear policies regulating the use and impact of generative AI, and Congress must strike the right balance to defend individual rights, abide by the First Amendment, and foster AI innovation and creativity,” said Senator Chris Coons of Delaware, one of the sponsors of the bill. The NO FAKES Act is also sponsored by Senators Marsha Blackburn of Tennessee, Amy Klobuchar of Minnesota, and Thom Tillis of North Carolina.
