Inadequate infection control practices endanger elders and violate the 14th Amendment.
The Department of Justice (DOJ) completed an investigation into two state veterans homes in New Jersey, concluding that subpar conditions there violated the Constitution’s 14th Amendment.
The two facilities were found to have put residents at risk through inadequate infection control and medical care. This resulted in an uncontrolled spread of serious infections, causing the two veterans’ homes to chart the highest number of deaths among residents compared to other facilities of similar size.
“We owe the veterans who served our nation our deepest thanks, and those veterans and their family members who live in these facilities have the right to appropriate care,” said DOJ’s Civil Rights Division Assistant Attorney General Kristen Clarke. “We look forward to working with the New Jersey Department of Military and Veterans Affairs to improve the conditions in these homes they operate and ensure these veterans and their families receive the care they need and deserve.”
