Letters follow an investigation into the sale of unauthorized products.
The U.S. Food and Drug Administration (FDA) sent warning letters to 30 retailers and one distributor, following an investigation into hundreds of retailers and distributors across the nation, for selling unauthorized tobacco products. These were various types of disposable e-cigarettes under the Puff and Hyde brands commonly used by young e-cigarette users in 2022. These letters are part of a nationwide effort to stop these sales to youth.
“Since becoming director of CTP, I’ve been crystal clear that FDA will not stand by while retailers and distributors seek to profit off illegally selling products that are well-known to appeal to youth,” said FDA’s Center for Tobacco Products Director Brian King. “Retailers and distributors play a key role in keeping unauthorized tobacco products off the shelves, and if they fail to do so, we’re committed to taking appropriate action.”
FDA Commissioner Robert Califf also stated that protecting the nation’s youth from tobacco products—including disposable e-cigarettes—is a top priority for the agency, which intends to enforce the law by holding all stakeholders in the supply chain accountable and not only manufacturers. The FDA plans to take action against anyone involved in the production, distribution, importation, or sale of unauthorized e-cigarette products.
