SCOTUS Issues Stay in Title 42 Case

President’s administration has until 5pm Tuesday to respond.

Supreme Court Chief Justice John Roberts issued an administrative stay after an emergency appeal was filed Monday by 19 states who claim they are ill-equipped to handle the increase in border crossings should Title 42 be lifted. The chief Justice gave President Biden’s administration until 5pm Tuesday to respond.

The high court has put a lower court’s order on hold with regard to lifting the immigration rule that allows border agents to turn back immigrants without allowing a request for asylum.

Last month, Title 42 had been ordered to be lifted by December 21 by U.S. District Judge Emmet Sullivan, who stated the policy violated federal law.

The Department of Homeland Security has requested emergency funding to handle the anticipated increase in border crossings.
