In the News…
Before leaving office, New York Governor Andrew Cuomo announced a healthcare worker vaccine mandate prompting more than a dozen healthcare professionals to request a court enjoinder. The governor’s mandate requires hospitals staff and employees of long-term care facilities to be vaccinated in order to remain employed.
A legal argument has taken shape under the umbrella of Title VII of the 1964 Civil Rights Act.
Judge David Hurd of the U.S. District Court for the Northern District of New York granted the temporary restraining order. “The vaccine mandate is suspended,“ the order reads, and the State Department of Health is “barred from taking any action, disciplinary or otherwise, against the licensure, certification, residency, admitting privileges or other professional status or qualifications of any of the plaintiffs on account of their seeking or having obtained a religious exemption from mandatory COVID-19 vaccination.”
His decision is certain to influence other federal judges facing similar matters across the country.
