Seeks protection for biologically female student-athletes.
Representatives Tulsi Gabbard of Hawaii and Markwayne Mullin of Oklahoma introduced legislation this week to make Title IX protections specific to female athletes based on their “biological sex.” This law is a reiteration of the Department of Education rule, released earlier this year, that educational institutions could lose federal funding due to the inclusion of biological males in female collegiate sports
Certain state and federal judges have ruled in favor of transgender women being included in schools’ female athletic programs. This bill from the House of Representatives would dovetail with the Department of Education Title IX rule, shielding it from judicial opposition, and relieve biologically female student-athletes from having to compete against biological males in women’s college sports programs.
Gabbard said that it “is critical that the legacy of Title IX continues to ensure women and girls in sports have the opportunity to compete and excel on a level playing field.”
