Lawsuit not in the scope of President’s employment.
A federal judge denied the Justice Department’s request that the United States replace President Trump as the defendant in a defamation lawsuit against him on Tuesday. The lawsuit alleges that the president raped a woman in a Manhatten department store in the 1990s. The decision made by U.S. District Judge Lewis A. Kaplan determined that a law protecting federal employees from being sued for things done within the scope of their office doesn’t apply in this case.
“The President of the United States is not an employee of the Government within the meaning of the relevant statutes,” Judge Kaplan wrote. “Even if he were such an employee, President Trump’s allegedly defamatory statements concerning Ms. Carroll would not have been within the scope of his employment.”
