Supreme Court to Hear Rare May Oral Arguments on Birthright Citizenship Restriction

Takes on in-person emergency filing against president’s executive order.

The Supreme Court has scheduled a rare May oral argument, extending its usual October to April argument season to hear a challenge to President Donald Trump’s executive order restricting birthright citizenship.

This May scheduling is also unusual in that it will hold arguments for an emergency appeal. Emergency appeals are usually resolved without any oral arguments, with the justices handing down a short written decision in response. 

This emergency application was filed by the Justice Department asking the Supreme Court to limit the number of injunctions imposed by lower courts against the president’s executive order. The signing of the order has led to lawsuits by individuals, organizations, and 22 states. The hold against the order will remain in place until the high court hears the case on May 15.
