Judge Blocks Labor Department from DEI Grant Screening

Justice Department spokesperson says they will continue to defend President Trump’s order “to end radical and wasteful government DEI programs.”

U.S. District Judge Matthew Kennelly of Chicago issued a preliminary injunction against the Labor Department last week to prevent the agency from requiring all grant recipients and public contractors to confirm that they do not uphold any diversity, equity, and inclusion (DEI) programs.

The Labor Department had imposed the policy in keeping with executive orders signed by President Donald Trump that addressed DEI hiring programs. The nonprofit Chicago Women in Trades sued the Labor Department over the policy, saying the executive orders directing it were so vague that they violate First Amendment Rights.

Judge Kennelly had previously issued a temporary injunction while he reviewed the case. He wrote, “Although the government emphasized, both in its briefing and at oral argument, that the certification provision implicates only illegal DEI programs, it has studiously declined to shed any light on what this means. The answer is anything but obvious.” 

In response to this ruling, Justice Department spokesperson Natalie Baldassarre said that her department “has vigorously defended President Trump’s executive actions, including the order to end radical and wasteful government DEI programs, and will continue to do so.”
