Supreme Court Allows Deportations Under Alien Enemies Act

The justices indicated that reviews of removals should be reviewed in the appropriate venue.

The Supreme Court vacated the temporary restraining orders that D.C. District Judge Boasberg placed on President Trump’s administration regarding the deportation of Venezuelan detainees. The justices ruled that the judge did not have jurisdiction to rule over migrants being held in Texas. The high court’s order reversed the lower court ruling that blocked President Trump’s administration from using the Alien Enemies Act of 1798 to remove five Venezuelan gang members from the U.S.

“The detainees are confined in Texas, so venue is improper in the District of Columbia,” the justices wrote of the challenge in U.S. District Court in D.C. “As a result, the Government is likely to succeed on the merits of this action.” 

The court indicated that migrants should be given adequate notice to bring habeas suits to challenge their removal by the government.

“As the court stresses, the court’s disagreement with the dissenters is not over whether the detainees receive judicial review of their transfers — all nine members of the court agree that judicial review is available,” Justice Kavanaugh wrote in a concurring opinion. “The only question is where that judicial review should occur.”
