In the News…

District Court Judge James Boasberg has kept a restraining order in place to halt deportations of illegal alien Venezuelans by President Trump’s administration under the Alien Enemies Act.

President Trump has designated the Tren de Aragua a criminal gang that has conducted an “invasion or predatory incursion against the nation.

Judge Boasberg wrote, “The President’s unprecedented use of the Act outside of the typical wartime context… implicates a host of complicated legal issues” such as whether a criminal group like Tren de Aragua constitutes a “foreign nation or government.”

The judge determined that the plaintiffs, five detainees of the Department of Homeland Security, are entitled to the due process of individual hearings. He wrote, “Because the named Plaintiffs dispute that they are members of Tren de Aragua, they may not be deported until a court has been able to decide the merits of their challenge.”
