DOJ Calls Judge’s Inquiry “Grave Encroachment” on Executive Authority

The judge requested more information on last weekend’s deportation flights to El Salvador and Venezuela.

The U.S. Department of Justice filed an argument this week calling for Judge James Boasberg to end “continued intrusions,” via court orders, into the Executive Branch’s authority on the deportation of illegal immigrants under the 1798 Alien Enemies Act.

“The underlying premise of these orders… is that the Judicial Branch is superior to the Executive Branch, particularly on non-legal matters involving foreign affairs and national security. The Government disagrees,” Justice Department lawyers wrote.

“The two branches are co-equal, and the Court’s continued intrusions into the prerogatives of the Executive Branch, especially on a non-legal and factually irrelevant matter, should end.”

Border Czar Tom Homan stated that he would stand by the court’s order regarding deportation and let “the DOJ and the courts fight this out as far as the Alien Enemies Act [and] how far we will go.“ He added, “We can hold TDAs up to six months before we remove them, so my comment there is we are going to keep doing what we are doing.”
