Federal Employees Return to Jobs in Administrative Leave Status

Federal judge orders them reinstated to active employment.

President Trump’s administration has taken back a number of federal workers who were laid off and placed them on paid leave.

Two court orders issued last week required the administration to rehire the tens of thousands of federal employees it laid off in a historic wave of mass firings. The orders, issued by District Judges James Bredar and William Alsup, ruled that the administration did not follow the legal requirements to enact the sweeping layoffs, which include a minimum of 60 days notice and a review of each employee’s tenure and qualifications.

A large number of workers were rehired after these orders, but the majority of them received notifications placing them on paid leave on their first day back on the job. Agencies reportedly include the National Park Service, the National Institutes of Health (NIH), the National Oceanic and Atmospheric Administration (NOAA), and the Environmental Protection Agency (EPA).

Judge Alsup stated the administrative leave violates his previous order. He wrote, “This is not allowed by the preliminary injunction, for it would not restore the services the preliminary injunction intends to restore.”
