District Judge William Alsup of San Francisco ordered federal agencies to “immediately” rehire tens of thousands of probationary workers this past week, saying that the “unlawful” decision was a “sham” strategy to circumvent legal requirements for mass downsizing.
The judge stated the federal government is required to follow “reduction in force” plans when downsizing their workforce, which necessitates at least 60 days of prior notice and in-depth reviews of each employee’s tenure. While clarifying that his order does not prevent President Trump’s administration from enacting a “reduction in force” that follows these procedures, he questioned the administration’s reasoning for the firings.
Judge Alsup emphasized the Justice Department’s reticence to bring witnesses for cross-examination, stating that the layoffs had nothing to do with employee performance.
