President Trump’s administration is set to reintroduce Title 42, the policy that enables the rapid expulsion of migrants based on public health concerns, such as the potential spread of diseases like tuberculosis. This measure, first implemented during the COVID-19 pandemic, authorizes border officials to bypass standard immigration processes, including the right to seek asylum.
The Centers for Disease Control and Prevention (CDC) is expected to issue an order categorizing unauthorized migrants as public health risks. Customs and Border Protection (CBP) will be carrying out expulsions to Mexico or other countries. While the policy intends to reduce detention facility overcrowding and disease transmission, it is likely to face legal challenges.
The administration’s immigration strategy also includes other restrictive measures, such as the 212(f) proclamation, which blocks entry deemed harmful to national interests. A lawsuit against the 212(f) proclamation is already being litigated.
