Secretary Noem suspended the 18-month extension made at the last minute by the previous administration.
The Department of Homeland Security (DHS) was sued by two organizations over Secretary Kristi Noem’s decision to rescind the Temporary Protected Status (TPS) for Venezuelans. The organizations claim that since Congress implemented the immigration program, it was necessary for Homeland Security to follow the protocol outlined for the program. The program offers no course of action to rescind any TPS designation.
The DHS secretary suspended the TPS extension at the end of last month after President Biden’s administration issued an additional 18 months of protection just weeks earlier. The previous DHS secretary combined separate and concurrent designations, which Secretary Noem said violated federal statute. The current Venezuelan TPS protections end in April.
