DOJ Asks Supreme Court to Freeze Pending Lawsuits

The acting solicitor general filed motions to reassess the previous administration’s actions.

Acting Solicitor General Sarah Harris asked the Supreme Court to freeze several pending cases previously filed by President Biden’s administration, filing proposed motions to return the cases to the Department of Justice (DOJ) for review.

“After the change in Administration,” Acting Solicitor General Harris wrote, the government will “reassess the basis for and soundness” of the lawsuits. The cases involve environmental policy, student debt relief, and transgender treatments for minors.

The motions leave the door open “to have the briefing schedule reinstated should the matter not be resolved,” but the filings signal the intent of President Trump’s administration to modify the previous administration’s policies that spawned the lawsuits in the first place.

If the Supreme Court accepts the motions, the lawsuits would be placed on hold indefinitely. If the court refuses, oral arguments for the lawsuits are likely to be scheduled in March or April.
