A New York appellate court turned down his request to postpone sentencing.
President-Elect Donald Trump has filed an emergency petition with the Supreme Court to stop sentencing in the case regarding falsified business records. Judge Merchan, who presided over the trial and conviction of President Trump, scheduled sentencing for this Friday after several delays since the jury’s decision last summer. The president-elect pleaded not guilty and has filed an appeal.
Judge Merchan also denied a motion to vacate the verdict in the case based on the presidential immunity decision handed down by the Supreme Court last year. The judge said he would issue a sentence of “unconditional discharge” and would not sentence Trump to prison.
The president-elect’s spokesman Steven Cheung said, “The Supreme Court’s historic decision on Immunity, the Constitution, and established legal precedent mandate that this meritless hoax be immediately dismissed.”
The spokesman continued, “American People elected President Trump with an overwhelming mandate that demands an immediate end to the political weaponization of our justice system.”
