Matthew  Joseph Kacsmaryk was born in 1977 in Gainesville, Florida. He earned an undergraduate degree from Abilene Christian University and received his Juris Doctor from the University of Texas School of Law. He spent ten years in the private practice of law. He spent five years as deputy general counsel to First Liberty Institute. 

He was nominated by President Donald Trump to be a judge on the United States District Court for the Northern District of Texas. His nomination expired before it was acted on, and he was again named by President Trump to the federal judgeship. Although his nomination was reported out of committee, the Senate did not take it up, and the president once again nominated Kacsmaryk to that district court. He was ultimately confirmed by the Senate and received his judicial commission in June 2019.

He is married to Shelly, and they have five children.

Federal District Court Judge Matthew Kacsmaryk of the North Texas U.S. District Court issued a preliminary injunction against a HIPAA rule change from the Department of Health and Human Services that changed the definitions to exclude disclosure of personal health information related to reproductive healthcare for investigations.

The federal health department was sued by a doctor and her clinic for allegedly violating the Administration Procedure Act. She also claimed that following the federal regulation would violate Texas law which requires the reporting of suspected child abuse in cases where a minor is being forced to have an abortion.

Judge Kacsmaryk stated, “Here it is not the state’s medical judgments that are contrary to law but… likely the 2024 Rule” which was issued after the Supreme Court’s decision to return abortion regulation to the states.

The judge agreed with the plaintiff that “forcing a doctor to toe a tightrope where the doctor must make complex factual, prudential, and legal judgments is exactly what HIPAA barred with respect to child abuse reporting.” He stated that HIPAA’s privacy rule “already protects reproductive healthcare information the same as all other sensitive medical information” and HHS “may not invoke an interest in engaging in a likely statutory violation.”
