DHS Streamlines H-1B Visa Program

The updated process enhances flexibility in obtaining approvals.

The Department of Homeland Security (DHS) recently finalized a rule updating the H-1B visa program to help U.S. businesses address workforce shortages.

Secretary Alejandro Mayorkas said, “These improvements to the program provide employers with greater flexibility to hire global talent, boost our economic competitiveness, and allow highly skilled workers to continue to advance American innovation.”

The updates include redefining specialty occupations, extending flexibility to nonprofit and governmental research organizations, and providing smoother transitions for F-1 visa students seeking H-1B status. Additionally, the rule accelerates processing for previously approved H-1B holders and allows beneficiaries with a controlling interest in petitioning organizations to qualify under specific conditions.

The rule also strengthens program integrity by granting  U.S. Citizenship and Immigration Services (USCIS) authority to conduct inspections and impose penalties, ensuring employers have bona fide positions for H-1B workers, and aligning Labor Condition Applications with petitions.
