Today is Election Day. Both Vice President Kamala Harris and former President Donald Trump have spent recent days campaigning heavily across the nation. The outcome is not anticipated to be determined for at least days, as certain states allow extra time to count ballots that are postmarked today.
The justices of the Supreme Court will hear arguments today in Becerra v. Empire Health Foundation, considering whether hospitals qualify for higher Medicare payment rates based on patients’ receiving benefits or simply eligibility for the benefits.
The high court will also hear E.M.D. Sales, Inc. v. Carrera regarding the burden of proof for employers under the Fair Labor Standards Act (FLSA). Six circuit courts decided that FLSA exemptions are applicable with a mere preponderance of evidence, while the Fourth Circuit Court ruled the requirement for clear and convincing evidence.
