The justices uphold the 8th Circuit’s injunction against the federal student loan forgiveness plan.
The Supreme Court declined the request from President Biden’s Administration to reinstate the Saving on a Valuable Education (SAVE) plan last week as legal challenges play out in lower courts. The Education Department launched the program early this year after the high court blocked an earlier student loan forgiveness program.
The Eighth Circuit U.S. Court of Appeals issued an injunction in July that prohibits the administration from implementing any part of the SAVE plan. Two lower court rulings had already blocked portions of the plan.
The case against the administration’s plan has been brought by several states that claim President Biden’s administration has overstepped its authority in proposing debt relief for borrowers without Congressional approval.
The Education Department reported that the millions of borrowers enrolled in the SAVE plan have their loan payments suspended and will remain in forbearance while litigation continues.
