President Joe Biden proposed term limits and a binding code of conduct for Supreme Court justices during his speech this week honoring the 60th anniversary of the Civil Rights Act.
“We need these reforms to restore trust in the court,” President Biden said at the presidential library of former President Lyndon B. Johnson in Austin, Texas. “I believe the best structure is the 18-year term limit.”
This is a notable proposal coming from an incumbent U.S. president, but Congress is unlikely to clear the high requirements necessary to make such steep changes to Supreme Court policy. In order to impose term limits and a code of conduct, the Senate and the House need to reach a two-thirds majority vote in both chambers. With the nearly even partisan split in Congress, the president’s proposal lacks a realistic path forward.
