5th Circuit Court Allows Texas to Keep Rio Grande River Buoy Barrier

The appellate court reversed the lower court’s decision on the immigration deterrent while the case is litigated.

The 5th Circuit Court of Appeals ruled that Texas can temporarily keep its floating barrier installed in the Rio Grande River, reversing a lower court’s decision to require its removal. 

President Biden’s administration had sued the state of Texas to remove the string of wrecking ball-sized buoys, claiming that it makes the shallow stretch of the river unusable for boats. In April, District Judge David Ezra upheld the administration’s case, issuing a preliminary injunction to have the buoy barrier removed while the case was processed.

Texas appealed the preliminary injunction to the 5th Circuit Court. In its opinion, the full 5th Circuit said the lower court “clearly erred in finding that the United States will likely prove that the barrier is in a navigable stretch of the Rio Grande.” This allows the floating barrier to remain in place while the case continues to move through the lower court.
