U.S. District Judge David Carter ruled that the Department of Veterans Affairs discriminated against disabled veterans by effectively rendering them ineligible for certain housing benefits.
Many disabled veterans receive financial benefits to help them manage their disabilities after their service. However, certain VA housing facilities require veterans’ income to be below a certain amount in order to be eligible for residency. When the facilities included disability income as part of a veteran’s total income, many disabled veterans have too high an income to be eligible for VA low-income housing.
A group of disabled veterans filed a class action lawsuit against the department after enough VA facilities practiced this type of income assessment, alleging that this was discriminatory. Judge David Carter sided with the plaintiffs, ordering the VA to submit a proposed solution for court approval to resolve this violation.
