Judge Cory Wilson
Fifth Circuit U.S. Court of Appeals
Cory Todd Wilson was born in August 1970 in Pascagoula, Mississippi. He earned an undergraduate degree in business administration from the University of Mississippi and received his Juris Doctor from Yale Law School. He clerked at the Eleventh Circuit U.S. Court of Appeals.
Wilson served as a White House Fellow in the Department of Defense as a special assistant to Secretary of Defense Donald Rumsfeld. He was a senior advisor and counsel in the Mississippi State Treasurer’s Office and was Deputy Secretary of State in the Mississippi Secretary of State’s Office.
He spent four years as a member of the Mississippi House of Representatives. He was appointed to the Mississippi Court of Appeals.
He was nominated by President Donald Trump to be a judge for the U.S. District Court for the Southern District of Mississippi. During his hearings before the Senate Judiciary Committee, his nomination was withdrawn and he was nominated to be a circuit judge of the U.S. Court of Appeals for the Fifth Circuit instead. He was confirmed by the Senate and assumed his judicial commission in July 2020.

The Fifth Circuit U.S. Court of Appeals questioned whether the Affordable Care Act requirement for insurers to cover certain preventive services is constitutional.
The court panel deliberated whether or not the volunteer U.S. Preventive Services Task Force has the authority to make disease prevention recommendations, since they are not appointed by the president nor confirmed by the Senate.
A district judge had ruled that enforcing their recommendations was a nationwide violation of the Appointment Clause of the U.S. Constitution.
In response to the argument that the injunction should apply only to the plaintiffs’ state of residence, Judge Cory Wilson said, “You wouldn’t vacate these things just for people in Texas or just for the plaintiffs — if they’re invalid, they’re invalid.”
