This week, the justices of the Supreme Court considered cases on maritime law, mortgage escrow accounts, who may assert claims in bankruptcy court, and whether or not a request for a federal hearing over a pandemic-related Executive Order is now moot.
The court heard arguments regarding whether state or federal law should govern the enforceability of maritime choice-of-law insurance clauses. The insured in question was in Pennsylvania, but the contract states the policy is governed by New York law.
The justices are also considering the preemption of state consumer financial laws under the National Bank Act and the payment of interest on mortgage escrow accounts.
