Judge Robert Luck
Eleventh Circuit U.S. Court of Appeals
Robert Joshua Luck was born in March 1979 in South Miami, Florida. He earned an undergraduate degree in economics from the University of Florida and received his Juris Doctor from the University of Florida’s Fredric G. Levin College of Law. He clerked at the Eleventh Circuit Court of Appeals.
After a time in the private practice of law, Luck worked as an Assistant United States Attorney for the Southern District of Florida. He was appointed to the Eleventh Judicial Circuit Court of Florida and later was appointed to the Florida Third District Court of Appeals. Governor Ron DeSantis named him to be a Judge of the Supreme Court of Florida where he served until his confirmation to the U.S. Court of Appeals.
President Donald Trump nominated Luck to a seat on the United States Court of Appeals for the Eleventh Circuit. After a cloture vote, his nomination was confirmed by the Senate, and he received his commission in November 2019.

A Black-owned venture capitalist firm has been temporarily blocked from awarding grants exclusively to Black women entrepreneurs.
The Eleventh Circuit U.S. Court of Appeals granted a motion for the stay after it was argued the grants violate Section 1981 of the U.S. Code, which guarantees equal rights for all who make and enforce contracts in the U.S., without discrimination or favor based on race.
In the opinion, Judge Robert Luck and Judge Andrew Brasher wrote, “We conclude that the plaintiff (AAER) has established that the defendants’ (the Fearless Fund) racially exclusionary program — the ‘Fearless Strivers Grant Contest’ — is substantially likely to violate 42 U.S.C. 1981.”
The judges rejected an argument that “although the First Amendment protects the defendants’ right to promote beliefs about race, it does not give the defendants the right to exclude persons from a contractual regime based on their race.”
