Jeffrey Stuart Sutton was born in October 1960 in Dhahran, Saudi Arabia. He earned an undergraduate degree in history from Williams College. He worked as a paralegal in Washington, D.C., later spending a summer as an archaeological intern at a dig site in Jordan as part of the U.S. Department of State cultural exchange program. Returning to the U.S., he taught at a private school in Columbus, Ohio. He earned a Juris Doctor from Ohio State University’s Moritz College of Law. He clerked at the Second Circuit Court of Appeals and later at the U.S. Supreme Court under Justice Antonin Scalia. 

He entered private practice. Sutton served four years as Solicitor General of Ohio. He was an adjunct professor of law at Ohio State University Moritz College of Law and as a visiting lecturer at Harvard Law School. 

President George W. Bush nominated Sutton to a seat on the U.S. Sixth Circuit Court of Appeals.  His nomination expired at the end of one congressional session, and he was renominated. The Senate confirmed him, and he received his commission in May 2003.  He became chief judge in May 2021.

A law passed in Tennessee that protects minors from irreversible “gender transition” surgeries and hormone treatments has been upheld for the time being by the Sixth U.S. Circuit Court of Appeals. The court granted the emergency appeal of a district court decision that blocked large parts of the law from taking effect statewide. 

In the Sixth Circuit’s ruling, Chief Judge Jeffrey Sutton wrote, “Given the high stakes of these nascent policy deliberations—the long-term health of children facing gender dysphoria—sound government usually benefits from more rather than less debate.“ 

 ”All told, the challengers lack a ‘clear showing’ that they will succeed on the merits.” 

“As for the public interest, Tennessee’s interests in applying the law to its residents and in being permitted to protect its children from health risks weigh heavily in favor of the State at this juncture,” the ruling said. 

The ruling is preliminary while the court conducts a full review of the appeal. Their goal is to have a final determination by September 30.
