Judge Patrick Bumatay
Ninth Circuit U.S. Court of Appeals
Patrick Joseph Bumatay was born in January 1978 in Secaucus, New Jersey. He earned an undergraduate degree from Yale University, spent three years as a paralegal in the Executive Office of the President, then earned a Juris Doctor from Harvard Law School. He clerked at the Tenth Circuit U.S. Court of Appeals.
He spent a year as a special assistant in the U.S. Department of Justice’s Office of Legal Policy, and another year at the office of the Associate Attorney General. He spent another year clerking, this time at the U.S. District Court for the Eastern District of New York. He spent two years in private practice.
Bumatay served as a federal prosecutor for the Southern District of California in San Diego as part of the Organized Crime and Drug Enforcement Task Forces Section.
He was nominated by President Donald Trump to a seat on the United States Court of Appeals for the Ninth Circuit. His nomination was not acted upon in a timely way and was returned to the president who renamed him. After a cloture vote, he was confirmed by the Senate and received his commission in December 2019.
Bumatay is married to Alex. They have adopted twin daughters.

A 2019 ordinance passed by the City of Berkeley, California, banned natural gas in the construction of new buildings. The city said the ban was necessary to support its goal of zero greenhouse gas emissions by 2050.
A three-judge panel of the U.S. Ninth Circuit Court of Appeals unanimously ruled in favor of the California Restaurant Association that appealed the ordinance. The court said the city’s efforts violated federal law that gives authority to set energy efficiency standards for appliances, such as gas stoves, to the federal government.
Writing for the court, Judge Patrick Bumatay said banning appliances such as gas stoves “impacts the quality of energy” they consume, which is under federal regulation.
