Judge Patrick Wyrick
Western Oklahoma U.S. District Court
Patrick Scott Wyrick was born in March 1981 in Denison, Texas. He grew up in Tulsa, Oklahoma. He earned an undergraduate degree from the University of Oklahoma and received his Juris Doctor from the University of Oklahoma College of Law. He clerked at the Eastern Oklahoma U.S. District Court, then entered private practice.
He served seven years as Solicitor General of Oklahoma before becoming an Associate Justice on the Oklahoma Supreme Court.
Wyrick was nominated by President Donald Trump to a seat on the U.S. District Court for the Western District of Oklahoma. His nomination was returned to the president when that Congress ended its term. President Trump renominated him, and after cloture, he was confirmed by the Senate. He received his judicial commission in April 2019.
In the News…
Individuals have been prohibited from owning firearms under federal law if they are “an unlawful user of or addicted to any controlled substance.” A year ago, an Oklahoma resident was indicted under that federal statute for having possession of both a handgun and marijuana.
District Court Judge Patrick Wyrick of the U.S. District Court for the Western District of Oklahoma said the federal rule is “unconstitutionally vague” and constitutionally violative.
In his ruling, Judge Wyrick said he was skeptical that the Constitution’s framers would have supported broad bans on “presumptively risky persons.” He said with such a reading, “The Second Amendment would provide virtually no limit on Congress’ discretion. The Framers’ weren’t perfect, but they also weren’t fools.”
Judge Wyrick’s ruling comes close on the heels of another court ruling that struck down a ban on gun ownership for individuals with domestic violence restraining orders against them.
