Judge Mark G. Mastroianni

Mark Gerard Mastroianni was born in May 1964 in Springfield, Massachusetts. He earned an undergraduate degree from the American International College and received his Juris Doctor from the Western New England School of Law.
He worked as an assistant district attorney in the Hampden District Attorney’s Office, then entered private practice. He later became the District Attorney of Hampden County, where he served for four years.
He was nominated by President Barack Obama to a seat on the U.S. District Court for the District of Massachusetts. After a cloture vote, he was confirmed by the Senate and assumed his commission in August 2014.
Mastroianni is married and has three daughters.

Federal District Judge Mark Mastroianni has dismissed a case brought by parents who stated that school officials’ compliance with requests from students struggling with gender identity issues amounted to failing to disclose a mental health issue.
Judge Mastroianni ruled that school officials did not violate the rights of parents when they allowed two former middle school students to change their names and pronouns in classrooms without informing their families.
In his dismissal, Judge Mastroianni said, “Since July 1, 2012, Massachusetts law has provided that ‘no person shall be excluded from or discriminated against… in obtaining the advantages, privileges and courses of student of [a] public school on account of …gender identity.’”
The judge further stated, “While parents have the option to send their children to public schools, they do not have constitutional rights to dictate how those schools educate them.”
“Addressing a person using their preferred name and pronouns simply accords the person the basic level of respect expected in a civil society generally, and, more specifically, in Massachusetts public schools where discrimination on the basis of gender identity is not permitted,” the judge’s ruling said.
