Labor Department Requires Stolen Tips Returned to Servers

 $61,788 improperly taken by restaurant management.

The U.S. Department of Labor recently investigated a Concord, New Hampshire restaurant operator, and found that managers were included in the distribution of the servers’ tip pool. The Wage and Hour Division of the federal agency conducted the investigation that resulted in the redistribution of $61,788 in tips back to the 39 employees.

“Restaurant employers must understand that keeping workers’ tips or diverting a portion of these tips to managers or supervisors in a tip pool is illegal,” said Wage and Hour Division District Director Steven McKinney in Manchester, New Hampshire. “To avoid costly mistakes, like those found in this investigation, employers should contact us to discuss their responsibilities.”
