Judge Patricia Millett

Patricia Ann Millett was born in September 1963 in Dexter, Maine. She earned an undergraduate degree in political science from the University of Illinois at Urbana-Champaign and received a Juris Doctor from Harvard University. She worked in private practice. She later clerked at the Ninth Circuit U.S. Court of Appeals.
Millett worked four years for the U.S. Department of Justice Civil Division, later becoming an assistant to the United States Solicitor General. She returned to private practice and also blogged on the activities of the U.S. Supreme Court.
She was nominated by President Barack Obama to a seat on the United States Court of Appeals for the District of Columbia Circuit. She was confirmed by the Senate and received her commission in December 2013.
She is married to Robert King and is a member of the United Methodist Church.

The Washington, D.C. Circuit U.S. Court of Appeals affirmed the order of a lower court rejecting former President Donald Trump’s request to withhold documents from the January 6 House select committee. The former president said that while he has the right to assert privilege, President Joe Biden is not required to honor it.
Judge Patricia Millett wrote the 68-page opinion in which she said, “Benjamin Franklin said at the founding that we have [a] Republic—if [we] can keep it. The events of January 6th exposed the fragility of those democratic institutions and traditions that we had perhaps come to take for granted.”
She added that in response, both the incumbent president and Congress determined that “access to this subset of presidential communication records is necessary to address a matter of great constitutional moment for the Republic.”
“Former President Trump has given this court no legal reason to cast aside President Biden’s assessment of the Executive Branch interests at stake, or to create a separation of powers conflict that the Political Branches have avoided,” the ruling said.
