Judge Matthew Schelp

Matthew Thomas Schelp was born in 1970 in Kansas City, Missouri. He earned a business administration undergraduate degree and a Juris Doctor from the University of Missouri. He enlisted in the United States Navy where he served in the Judge Advocate General’s Corps.
He served as an Assistant United States Attorney for the Eastern District of Missouri and was also in private practice.
Schelp was nominated by President Donald Trump to serve as a judge for the United States District Court for the Eastern District of Missouri. His nomination was returned to the president without being acted upon, and the next day he was re-nominated. After a cloture vote, the Senate confirmed him in a 72-23 vote. He received his judicial commission in August 2020.

A preliminary injunction by the U.S. District Court for the Eastern District of Missouri marks the first victory for those who oppose the president’s mandate which required healthcare workers to be vaccinated by January 4, 2022.
The lawsuit is one of four challenges the Centers for Medicare & Medicaid Services faces against the rule. More than half the states are now involved in one of the challenges, all of which claim the mandate will exacerbate staffing shortages. Some experts say the mandate is on firm footing because the Medicare agency has the right to govern the rules facilities must follow if they receive funding.
But U.S. District Court Judge Matthew Schelp said that the CMS vaccine mandate is most likely an overstep of the agency’s authority. “The nature and breadth of the CMS mandate requires clear authorization from Congress—and Congress has provided none,” he said.
“The vast economic and political significance” of the mandate also warrants a preliminary injunction, Judge Schelp said. The CMS estimated that the first year of compliance would cost $1.38 billion, and represents the “heavy hand of the federal government.”
