10 states challenge administration vaccine mandate for health care professionals as unconstitutional.
Louisiana Western District U.S. Judge Terry Doughty issued a nationwide injunction barring enforcement of the president’s vaccine mandate for federally funded healthcare facilities on Tuesday. On Monday, Missouri U.S. District Judge Matthew Schelp had issued an injunction barring the enforcement in 10 states. Judge Schelp deemed the mandate unconstitutional and an overreach of power as well as a detriment to the healthcare system.
Judge Doughty wrote, “If the executive branch is allowed to usurp the power of the legislative branch to make laws, two of the three powers conferred by our Constitution would be in the same hands.” The Louisiana judge added, “If human nature and history teach anything, it is that civil liberties face grave risks when governments proclaim indefinite states of emergency.”
